Abstract
The French securities commission – namely the Commission des opérations de bourse (COB) from 1967 to 2003 and the Autorité des marchés financiers (AMF) since 2003 – plays an important role to make the legal and regulatory framework of the French financial marketplace more competitive. Nevertheless this particular function is not covered by the legal objectives given by the parliament (safeguarding savings, supervising information and maintaining orderly financial markets). This article investigates the legitimacy of this policy as well as the legal tools and strategies that the French securities commission can use to promote the financial centre. Finally a new writing of the legal mission of the AMF is suggested including the promotion of the French financial centre based on a better regulation.
