The sale of a building and land with a conservatory legal mortgage is undeniably possible since the Law of July 9, 1991, which will take effect from January 1, 1993. However, organizing the rights of the creditor in whose favor the conservatory legal mortgage has been drawn up is difficult because the new law is not well clarified. Its application over time will prove to be very complex.
